Litigation Attorney – Debt Collection Defense
Department: Legal
Reports To: VP of Legal & HR
Status: Exempt / Full-Time
Position Overview
We are seeking an experienced Litigation Attorney with expertise in debt collection defense to join our legal team. This role is responsible for representing the company and its clients in defense of claims, disputes, and lawsuits, with a primary focus on collections defense, regulatory compliance, and commercial litigation.
The ideal candidate has hands-on defense experience under the Fair Debt Collection Practices Act (“FDCPA”), Fair Credit Reporting Act (“FCRA”), and Telephone Consumer Protection Act (“TCPA”); strong negotiation skills; and the ability to manage a high-volume caseload while maintaining strategic oversight and compliance.

Requirements
Key Responsibilities
Case Management & Strategy
- Defend lawsuits involving debt collection and consumer claims.
- Develop and execute litigation strategies from intake through resolution.
- Draft, review, and file pleadings, motions, and responses in state and federal courts.
Courtroom Representation
- Represent the company in hearings, mediations, arbitrations, and trials as needed.
- Negotiate settlements, dismissals, and judgments aligned with business objectives.
Litigation Support & Compliance
- Collaborate with the VP of Legal on strategy, risk assessment, and case updates.
- Partner with compliance, collections, and business teams to ensure adherence to FDCPA, FCRA, TCPA, and state regulations.
- Oversee discovery, including interrogatories, depositions, and document production.
- Review contracts, financial agreements, and supporting documentation for litigation preparedness.
- Manage the internal litigation log and ensure consistent tracking and reporting of active matters.
- Lead litigation budget forecasting to ensure accuracy, accountability, and alignment with company goals.
- Advise leadership on litigation risk, case exposure, and regulatory changes.
- Assist in drafting policies, procedures, and best practices to minimize risk.
Qualifications
- Education: Juris Doctor (JD) from an accredited law school.
- License: Active license in good standing to practice law in the state where licensed; multi-jurisdictional admission a plus.
- Experience: Minimum 5 years of defense litigation experience, with a focus on debt collection, creditor rights, or commercial litigation.
- Strong knowledge of consumer protection laws (FDCPA, FCRA, TCPA), collections regulations, and litigation procedures.
- Demonstrated ability to manage a large caseload efficiently.
- Excellent legal writing, research, and oral advocacy skills.
- Skilled in negotiation, mediation, and conflict resolution.
- Ability to work collaboratively across compliance, finance, and business teams.
- Familiarity with case management systems and e-filing platforms.
- Background in regulatory defense or interaction with agencies (CFPB, FTC, state AG offices) is a plus.
